Publication by Peter Csoklich and Maximilian Wallergraber on the Electronic Consignment Note (eCMR)

In the latest issue of RdW – Recht der Wirtschaft (LexisNexis), DSC partner Peter Csoklich and DSC attorney-at-law Maximilian Wallergraber analyze a recent decision of the Austrian Supreme Court (OGH) regarding the consignor’s liability under Article 7(1) CMR.

The decision addresses, for the first time, the question of whether the strict liability of the consignor necessarily requires a valid CMR consignment note.

The ruling provides important clarification for transport law practice. At the same time, the article highlights further practical questions arising in connection with the electronic consignment note (eCMR), particularly regarding its handling and authentication in cross-border road transport.
