At this year's spring meeting of the Legal Committee of the European Federation of Building Societies (EFBS), DSC Partner Markus Kellner speaks about the ECJ ruling C-555/21.
The proceedings were initiated by a request for a preliminary ruling by the Austrian Supreme Court. The question was whether the ECJ decision C-383/18 Lexitor on Art 16 Consumer Credit Directive applies to Art 25 Credit Agreements for Consumers relating to residential immovable property; the proceedings thus revolved around the pro rata reimbursement of costs not related to the term (such as credit processing fees) in the event of early repayment of consumer loans.
Our banking law team (Markus Kellner and Fabian Liebel) achieved major success for our client UniCredit Bank Austria and the European banking industry before the ECJ. The Court followed the arguments of our client: National law may limit the reduction of costs in case of early repayment of WIKrRL loans to non-maturity-related costs.
