In the latest issue of the Austrian Jurist:innen Zeitung (ÖJZ 2025/68), published by Manz Verlag, DSC partner Christoph Leitgeb and DSC attorney David Tritremmel analyze the Austrian Supreme Court’s case law on the assertion of assigned claims for damages resulting from online gambling losses.
The article focuses on the question of international jurisdiction under Article 7(2) of the Brussels Ia Regulation (EuGVVO), particularly regarding the localization of the place where the harmful event occurred (“Erfolgsort”) in the context of assigned claims. The authors critically examine recent OGH decisions, drawing on the relevant European legal framework and the case law of the CJEU.
The article also provides an outlook on the pending preliminary ruling procedure in case C-77/24 (Wunner), in which the authors represent the defendant parties.
